​Definitions of words used in the Terms and Conditions

FSA, We, Us Fenland Swim Academy

You – the customer

Guardian – a person other than the parent who brings the child to the lesson

Acceptance of Terms

Please read through the terms and conditions. By signing up to lessons with Fenland Swim Academy, you are agreeing to the terms and conditions set out below. We reserve the right to change our terms and conditions at any time.

​

Booking Conditions

Following a verbal or physical assessment of the participants swimming ability we can provisionally book you into a class and hold the space for a maximum of 24 hours. You must complete the bank transfer of the monies requested to you by email within 24 hours of your space being provisionally reserved to confirm and secure your place. Failure to do this will result in that space being opened up to another swimmer.

Should the day and/or time no longer be convenient to you we can look at an alternative space available, however, we cannot guarantee any specific space(s).

Fees & Payment – Group Lessons

For group lessons your first payment and subsequent payments will be paid by you by bank transfer on a monthly direct debit which you will need to set up within 24 hours of your space being reserved. Your first payment may be up to 8 lessons of fees to ensure you have enough credit in your account, so you are always paying for lessons in advance.

Payment must be made on the agreed date each calendar month. Failure to do so will result in your space(s) being taken by a swimmer on our waiting list. The fees are not refundable under any circumstance other than with the written consent of FSA.

​

When signing up to FSA, you will also be charged a one-off £10.00 joining fee. By paying this joining fee you will be able to access our parent portal.

​

If your payment fails for any reason, this may result in you losing your space or a charge may be added to your bill.

​

Direct Debit subscriptions are worked out pro-rata. There are 46 lessons per annum and this is split evenly throughout the 12 months. Your subscription date will be the 4th of each month, unless agreed otherwise, and the first date will be given to you upon sign up. Late payments or missed payments may incur an additional charge.

​

A receipt can be requested but is not given out at the time of payment.

​

Prices may change with a minimum of 4 weeks notice given and these changes will be communicated by email and text to all customers.

Fees & Payment – Private Lessons

For private lessons, payment will be paid by bank transfer in 6 week blocks. On week 4 of each block you will be sent a new payment request for the next 6 week block. Payment for each block is to be paid within 24 hours of receiving the payment request. Failure to do so will result in your space(s) being taken by a swimmer on our waiting list. The fees are not refundable under any circumstance other than with the written consent of FSA.

Lesson Conditions

All classes are 30 minutes long unless specified otherwise and run for 46 weeks a year. We reserve the right to cancel classes due to unforeseen circumstances, if a lesson is cancelled, we will offer a catch up class or should this not be available we will offer a credit note or refund for the missed lesson(s)

During the lessons the swimmer’s parents/ guardian must be within the swimming pool building for the duration of the lesson.

​

Where possible we will always try to ensure you have the same teacher (unless you choose to move time or your swimmer moves up a group). On some occasions the teacher may change for reasons such as illness or holidays. Refusal to accept the replacement teacher will result in you forfeiting the lesson.

​

Changing or Cancelling lessons

You can request to change your time and day of lesson, subject to availability. This must be done by sending an email.

​

For group lessons, any lessons missed due to illness, holiday’s, school events etc will not entitle you to a refund or a catch-up lesson.

​

For private lessons, a partial refund of 50% will be issued in the form of a credit note if 48 hours’ notice or more is given. FSA requires at least 2 weeks’ notice for a full credit note. Failure to provide the relevant notice will result in you losing that lessons payment.

​

Should you wish to cancel your swimming lessons with FSA, you must put your request in an email to notify us of this prior to cancelling your direct debit. We will acknowledge your request via email and inform you of your final lesson date.

​

Swimwear

Swimmers must wear appropriate swimwear at all times. Swimmers ‘potty training’ or who usually wear nappies must abide by our double nappy policy which would include either a disposable or reusable swim nappy with a neoprene nappy on top.

​

Swim hats must be worn at all times for swimmers over the age of 3.

​

Video and Photography

Photography or videoing is strictly prohibited during any lessons without prior agreement from an FSA member of senior staff. Any photographs or videos should avoid including other swimmers. Any customer seen taking phots or videos without permission during a lesson may be asked to show the footage and then delete it.

​

FSA cannot be held accountable for photographs or video footage taken by parents/carers but we will ensure reminders are visible in the spectating area.

​

Employees of FSA may take photographs of swimmers whilst engaged in their swimming lessons. Employees will only take photos of swimmers who have agreed to their photos and videos been taken when signing up. These photos will be used for assessment purposes, celebrating success or for promotional posts on social media and/or the website.

​

Valuable and Jewellery

All property left in changing rooms or on poolside, and all property (including pushchairs) left in the entrance hall office area or outside is left at your own risk. FSA cannot accept any responsibility for loss or damage.

​

All jewellery with the exception of wedding rings should be removed before swimming.

​

Health and Safety

The participant should not partake in their swimming activity if they have any illness that could be spread to other swimmers or teachers. In the instance of sickness and/or diarrhoea the pupil, parent or guardian must have been clear of all symptoms for 48 hours before attending their class.

​

For baby changing we recommend changing your baby on the designated baby changing tables or if not available, on the floor on a suitable changing mat. Babies should not be changed on any other raised areas such as benches. This is to prevent babies from rolling on to the hard floor from a height. FSA does not take responsibility for any injuries if you choose to use a changing method other than the changing tables and mats provided.

If the swimming participant has any conditions or additional needs that could impact their capabilities in the pool it is the the responsibility of the parent/guardian to provide correct and updated medical information to FSA.

​

There is to be no running on poolside under any circumstance. No swimmer should enter the pool until instructed to do so by an FSA member of staff.

​

Data Protection and Privacy

By booking lessons or private hire we will require you to register your details and your child(ren) with us.

​

This information will be used by FSA only and is stored on a secure and protected server. Your data will not be shared with any third parties unless required to do so for the booking process or where we are legally required.
